Welcome to PatchForge. These Terms and Conditions ("Terms") govern your use of the PatchForge web application and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Acceptance of Terms

By creating an account or using PatchForge, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of the Service following any changes indicates your acceptance of the new Terms.

2. Description of Service

PatchForge is a web-based application that leverages artificial intelligence and natural language processing to automate the creation of clear and concise patch notes from software development commits. The Service integrates with project management tools such as GitHub and JIRA to streamline the documentation process for software updates.

3. User Accounts

3.1 Account Registration

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for any reason, including but not limited to violation of these Terms, without prior notice or liability.

4. Subscription and Payment

4.1 Subscription Plans

PatchForge offers subscription-based access to the Service. Subscription plans and pricing are displayed on our website and may be updated from time to time.

4.2 Payment Terms

By subscribing to a paid plan, you agree to pay all applicable fees as described at the time of purchase. Payments are processed through our third-party payment processor, Paddle. All fees are non-refundable unless otherwise specified.

4.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel your subscription before the renewal date. You may cancel your subscription at any time through your account settings.

5. Use of Service

5.1 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service in any way that violates any applicable federal, state, local, or international law or regulation
  • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service
  • Attempt to gain unauthorized access to any portion of the Service or any other systems or networks connected to the Service
  • Use any automated system to access the Service in a manner that sends more request messages than a human can reasonably produce
  • Introduce any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful

5.2 Third-Party Integrations

The Service integrates with third-party platforms such as GitHub and JIRA. Your use of these integrations is subject to the terms and conditions of those third-party services. We are not responsible for the availability, accuracy, or content of third-party services.

6. Intellectual Property Rights

6.1 Service Content

The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio) are owned by PatchForge Inc., its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 User Content

You retain ownership of any content you submit to the Service ("User Content"). By submitting User Content, you grant PatchForge a worldwide, non-exclusive, royalty-free license to use, reproduce, process, and display your User Content solely for the purpose of providing the Service to you.

6.3 Generated Content

Patch notes and other content generated by the Service using your User Content are owned by you. PatchForge does not claim ownership over the generated content.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy. We implement reasonable security measures to protect your data, but we cannot guarantee absolute security.

8. AI-Generated Content

PatchForge uses artificial intelligence to generate patch notes. While we strive for accuracy, AI-generated content may contain errors or inaccuracies. You are responsible for reviewing and verifying all generated content before use. PatchForge is not liable for any damages resulting from your reliance on AI-generated content.

9. Disclaimers and Limitation of Liability

9.1 Service "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PATCHFORGE INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

10. Indemnification

You agree to indemnify, defend, and hold harmless PatchForge Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of Manitoba, Canada, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Winnipeg, Manitoba, and you hereby consent to personal jurisdiction and venue therein.

12. Changes to Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PatchForge Inc. regarding the use of the Service and supersede all prior agreements and understandings.
